Terms of Service

1. Agreement to Terms

By accessing or using the NexonTech platform at nexontech.org ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

NexonTech ("we," "us," or "our") reserves the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

NexonTech is a platform that enables businesses to build, configure, and deploy custom AI-powered chatbot agents. The Service includes:

  • A dashboard for creating and managing AI agents
  • Document upload for building agent knowledge bases
  • An embeddable chat widget for deployment on your website
  • Conversation analytics and monitoring
  • An interactive demo for evaluating the platform

3. Account Registration

To access certain features of the Service, you must create an account using an email address and password or through Google sign-in. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Distribute malware, spam, or harmful content through your AI agents
  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Use AI agents to generate content that is deceptive, fraudulent, or misleading
  • Overload, disrupt, or interfere with the Service or its servers
  • Scrape, crawl, or harvest data from the Service without authorization
  • Use the Service to build agents that provide medical, legal, or financial advice without appropriate disclaimers and professional oversight

5. Your Content and Data

You retain ownership of all content you upload to the Service, including documents, agent configurations, and instructions ("Your Content"). By uploading content, you grant us a limited license to process, store, and use Your Content solely to provide and improve the Service.

You are responsible for ensuring that Your Content does not infringe on any third-party intellectual property rights and complies with applicable laws. We may remove content that violates these Terms.

6. AI-Generated Content

The AI agents built on our platform generate responses using artificial intelligence. You acknowledge that:

  • AI-generated responses may not always be accurate, complete, or appropriate
  • You are responsible for reviewing and validating AI agent outputs
  • AI agents should not be used as a sole source of professional advice
  • We do not guarantee the accuracy or suitability of any AI-generated content

You are solely responsible for the behavior and output of AI agents you create and deploy, including any interactions they have with your end users.

7. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is owned by NexonTech and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, branding, or proprietary materials.

AI agents you create and their configurations belong to you. However, we retain rights to the underlying platform technology and any aggregated, anonymized usage data.

8. Service Availability

We strive to maintain high availability of the Service, but do not guarantee uninterrupted or error-free operation. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law, NexonTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless NexonTech, its officers, and employees from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms or if we determine that your use poses a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We may retain Your Content for a reasonable period to comply with legal obligations, after which it will be deleted.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Moldova. Any disputes arising from these Terms shall be resolved in the courts of the Republic of Moldova.
